Fermata Rental Protection Policy

At Fermata, we believe musicians should be able to rent equipment with confidence. To help protect both equipment owners and renters, Fermata offers optional Rental Protection through approved third-party insurance partners on eligible transactions.
This policy explains how Rental Protection works and the responsibilities of all parties involved.
What is Rental Protection?
Rental Protection is an optional protection plan available during eligible rentals.
It is designed to provide additional financial protection against certain covered losses or damages that may occur during a rental period.
Rental Protection is not automatically included with a rental and must be selected during checkout when available.
Optional Coverage
Renters may choose to:
-Purchase Rental Protection for an additional fee; or
-Decline Rental Protection and accept full responsibility for the rented equipment during the rental period.
Equipment owners may also specify whether Rental Protection is required or optional for their listings, where supported by the Platform.
What Rental Protection May Cover
Depending on the terms of the applicable third-party provider, Rental Protection may provide coverage for:
Accidental physical damage
Certain theft claims
Covered transportation-related damage
Certain covered repair costs
Other covered events described by the insurance provider
Coverage varies by provider, location, equipment type, and applicable policy.
What Rental Protection Does Not Cover
Rental Protection generally does not cover:
Intentional damage
Normal wear and tear
Cosmetic damage that does not affect functionality
Mechanical or electrical failure caused by age or improper maintenance
Unauthorized modifications or repairs
Damage caused while using equipment unlawfully
Fraudulent claims
Equipment abandoned by either party
Losses specifically excluded by the applicable insurance provider

User Responsibilities
Equipment Owners
Owners agree to:
List equipment accurately.
Provide current photographs.
Disclose known defects.
Deliver equipment in safe working condition.
Report damage promptly.
Cooperate during investigations.
Renters
Renters agree to:
Use equipment responsibly.
Follow manufacturer recommendations.
Protect equipment from theft or misuse.
Return equipment on time.
Report accidents or damage immediately.
Cooperate during claims investigations.
Damage Reporting
If damage occurs, users should report it through Fermata as soon as reasonably possible.
Reports should include:
Description of the incident
Date and time
Photographs or videos
Supporting documentation
Police report, if applicable
Failure to report damage promptly may affect claim eligibility.
Claims Process
When Rental Protection has been purchased:

The incident is reported through Fermata.

Information may be shared with the insurance provider.

The insurance provider determines claim eligibility.

Covered claims are processed according to the provider's policy.
Fermata facilitates communication but does not approve or deny insurance claims.
Claim Decisions
All coverage determinations are made solely by the applicable third-party insurance provider.
Fermata does not:

Guarantee claim approval

Guarantee reimbursement

Interpret policy coverage

Modify insurance decisions
Coverage is subject to the provider's terms, conditions, exclusions, and limitations.
If Rental Protection Was Not Purchased
If Rental Protection is declined:
The renter accepts full financial responsibility for any damage, loss, or theft occurring during the rental period, except where otherwise required by law or agreed upon by the parties.
Equipment owners and renters are encouraged to resolve claims directly through Fermata's dispute resolution process.
Fraud Prevention
Fermata may investigate suspected fraudulent claims.
Users must not:
Submit false documentation
Misrepresent equipment condition
Alter evidence
Make fraudulent insurance claims
Fraud may result in:
Claim denial
Account suspension
Permanent removal
Legal action where appropriate
Equipment Inspection
Owners are encouraged to inspect equipment before and after every rental.
Both parties should:
Take clear photographs before pickup.
Document existing wear or damage.
Confirm equipment functionality before the rental begins.
This documentation helps facilitate faster claim reviews if necessary.
Limitation of Liability
Rental Protection does not create a guarantee by Fermata that any loss, damage, or claim will be reimbursed.
To the fullest extent permitted by law, Fermata is not liable for:
Equipment damage
Theft
Loss of use
Lost income
Missed performances
Consequential damages
Insurance claim decisions
Policy Changes
Fermata may modify this Rental Protection Policy from time to time to reflect operational changes, legal requirements, or updates from insurance partners.
Updated versions will be posted on the Platform.
Continued use of the Platform after changes become effective constitutes acceptance of the revised policy.
